FAMILY LAW

John has been practicing Family Law since early in his legal career, including divorce, custody cases, child custody and visitation modifications, adoptions, child support, paternity actions, emergency protective and domestic violence order petitions, and prenuptial agreements.

CRIMINAL LAW

When you are wrongfully accused of a crime, it can often feel like that everyone is against you and that there is no justice. 

John will listen to you and carefully evaluate your case and take all actions necessary to defend you, including interviewing witnesses, representing you at a pretrial conference or preliminary hearing, filing pretrial motions, carefully examining evidence obtained by the prosecution, retaining experts, and representing you in a jury trial.

BANKRUPTCY

If you are in the aftermath of losing your job, or you are facing mounting medical and/or credit card bills, you may need to file for bankruptcy.  There is no longer a stigma today associated with filing for bankruptcy.  There are two available options under federal law for those faced with consumer debt.  Chapter 7, which is a liquidation., or Chapter 13, which is a reorganization requiring you to make payments to a trustee over a 5 year period of time.

Bankruptcy is a relatively painless process.  A Chapter 7 bankruptcy can be completed in as little as a few months.  And through John’s association with several credit repair companies, may be able to restore your credit very soon after completing bankruptcy.

AUTOMOBILE ACCIDENTS

Being injured in an automobile accident can be a devastating event not only for you, but for your entire family.  If you are involved in a car wreck, you are probably faced with numerous doctor visits and not being able to work which causes a hardship.  The insurance company may be pressuring you to give a statement or to settle your claim for pennies on the dollar.

If you have been involved in a car wreck or have lost a loved one in an accident, before doing anything, you should always contact a lawyer to be informed of your rights and how you should proceed.  You should never talk to an insurance company or any witnesses to the accident without a lawyer present.  John has the background, knowledge and experience necessary to recover damages in the form of lost wages, medical expenses, emotional distress, punitive damages and other damages associated with a car wreck.

WRONGFUL DEATH

After losing a loved one the last thing you want to think about is filing a lawsuit to recover damages for loss of life.  You are going through the grieving process and it is difficult to think about anything other than that person who meant so much to you and others.

If you think someone negligently caused the death of another, then it is important for you to contact a lawyer.  Evidence will need to be gathered very early in the process and it may be necessary to retain an expert to determine what truly happened.  You should also be aware that children and spouses of someone killed due to the negligence of another person have claims in addition to the claims for damages due to the death of a loved one.

ESTATE PLANNING/PROBATE

Over the course of his career, John has prepared many Wills, Living Wills, Designations of Health Care Surrogate and General Durable Power of Attorneys. 

It is important that you have an estate plan in place.  After all, you cannot speak from the grave and the disposition of the property of your estate upon your death may not be what you intended.  For most families, simple estate planning will ensure that property goes to persons you want them to go to upon your death and that your minor children will be cared for by another.  Also, your loved ones may not know your wishes regarding life prolonging treatment and may not be able to take care of your affairs if you are hospitalized.  Having a Living Will with a Designation of Health Care Surrogate and a Power of Attorney will ensure that your loved ones will know your wishes regarding life prolonging treatment and can handle your personal affairs when you cannot speak for yourself.

Additionally, you may be facing the death of a loved one and need to probate his or her will or estate.  John has filed many probate actions over the years and knows the process and procedure for probate.  His years of experience can guide you and make probate a relatively smooth process.

REAL ESTATE

During the early years of his career, John performed hundreds of title searches and conducted residential and commercial real estate closings.  John has also handled numerous quiet title actions in circuit court.  In connection with his real estate experience, John has prepared hundreds of deeds, conducted cash closings between private parties, and is very capable of conveying title to your real estate as well as determining the state of your title and whether any clouds on title to your property may exist.  John’s background, skills and experience in this area make him uniquely qualified to represent you in resolving real estate title disputes and/or conducting a real estate closing in association with your bank or other lender.

CORPORATE LAW

During his tenure at Frost Brown Todd LLC, John gained much experience handling corporate matters.  If you own a small business, John has the knowledge, background and experience to take care of all of your legal needs.  From forming a Limited Liability Company (LLC) to corporate governance matters and preparing corporate documents and filings with the Secretary of State, John is your one stop shop for managing your business’ legal needs.  John has also handled many commercial transactions involving secured transactions pledged with real property and personal property.
